Terms of sale and delivery, business
Insight Cosmetics Group markets products and services in Scandinavia, Germany, Austria, and Switzerland ("DACH"). The contractual partner for customers in Germany is Insight Cosmetics Group Deutschland GmbH, Grüner Weg 10, D-50825 Cologne, Germany. The contractual partner for customers in all other countries is Insight Cosmetics Group A/S, Hejreskovvej 20C DK-3490 Kvistgaard, Denmark. The following General Terms and Conditions apply to all countries; to improve the flow of reading, both aforementioned companies are abbreviated to "Insight Cosmetics Group" or "ICG", unless it is necessary to state the entire address in individual cases.
Insight Cosmetics Group offers products and services to professional buyers (customers). Professional buyers include companies or individuals who operate a registered business in the cosmetics industry, or individuals who have completed, or are in the process of completing, professional training accepted by ICG.
In special cases, ordinary consumers can buy e.g. outdated goods directly from the web store. Regarding these deliveries, please see the last paragraph, "Terms and conditions, not companies".
ICG imposes specific requirements on professional purchasers, including, among other things, requirements for ongoing maintenance of ICG-approved educational levels (certification), a minimum range of professional services, and requirements for decor and location of the branch office, including requirements for designing any website.
The client is responsible for keeping abreast of these requirements and ensuring they are continuously met. Failure to do so may result in ICG terminating the deal without notice, reclaiming any inventory, and requiring compensation for direct and indirect losses.
No products may be resold for distribution unless ICG's written consent is obtained in each case.
If there are product descriptions and operating instructions for the product, they often follow along with the ICG shipment. Announcement and Safety Descriptions (MSDS) for most products can also be downloaded from the ICG website (please request password). If further information or advice is desired from ICG, it is provided for reference only. ICG ensures that products comply with CE marking requirements.
If products are to be resold, even partially, the professional purchaser must ensure that all instructions for use, application and warnings, if any, are kept visible and accessible to customers (end users) and potential customers.
Any customer may request a booklet of application and safety instructions in local language to be sent to them free of charge at any time. Please contact ICG customer service.
A large part of the products supplied by ICG are reserved for use in clinics for treatment by professionally trained personnel for safety and health reasons. The personnel must have an authorization (diploma) issued by ICG or a training institution recognized by ICG. ICG may at any time withdraw or cancel an assigned authorization if ICG estimates that the client is not meeting what is perceived as professional responsibility and good practice by ICG.
The client is responsible for ensuring that only products marked for resale (labeled with an RRP) are sold to the consumer, as well as the client is responsible for ensuring that treatments are performed only by properly authorized personnel and under the legally correct working conditions. Otherwise, ICG is also entitled to refuse future deliveries.
Products for professional use may therefore not be resold or used for purposes other than the treatments that the customer is authorized to offer. The products may also not be used in connection with educational purposes unless the customer has permission from ICG and is properly authorized to do so.
If ICG inadvertently supplies professional products to a customer without the required authorization, ICG may at any time require the return of such products upon issuance of a credit note.
Nimue brand products may not be sold over the Internet, whether professional products or products for resale.
Customer orders can be placed either by phone, e-mail, fax, or via the Internet. All orders are binding on the part of the customer immediately after submission. This also applies to courses and other services.
Orders are processed immediately by ICG as far as possible.
ICG ships all goods directly to the customer's warehouse. The customer is responsible for the shipping charges and assumes the risk for the goods once they leave ICG's warehouse. Shipments are generally handled by PostNord and DSV (GLS).
Orders are processed and dispatched on business days*. Any orders placed before 3:00 PM will be shipped the same day, when possible.
Shipping fees apply to all orders. However, orders exceeding EUR 70 excluding VAT qualify for free shipping (excluding Greenland, the Faroe Islands and Iceland).
It is the customer’s responsibility to ensure that ICG has accurate shipping information, including the correct address, email, and mobile number. If a shipment cannot be delivered due to issues on the customer’s side or if the parcel is not picked up during the storage period, ICG reserves the right to charge for any return handling or reshipping.
A return handling fee of EUR 7 per package will be charged. Additionally, if an address correction is required, a fee of EUR 10 will be charged to the customer.
Customers must track their shipments and report any issues - such as non-receipt or missing items - within 14 days of dispatch. In case of damage, please take photos and use [the complaint form] to submit a report.
Please note that any missing or undelivered shipments must be reported to ICG within 14 days of dispatch. After this period, we will be unable to open an investigation with the carrier or confirm the final status of the shipment.
The customer must check the goods as soon as they are received at the delivery address. Any errors or defects in delivery from ICG must be reported as soon as the customer discovers the issue and no later than 4 days after receipt. It is the customer’s duty to state and, upon request, demonstrate how the error or defect appears.
Cosmetic products with a shelf life of less than 30 months before opening (calculated from the production date) are marked with an expiry date in accordance with the cosmetics directive. If the customer wishes to make a complaint regarding the remaining shelf life of delivered goods, the customer must also submit the complaint within 4 days after receiving the relevant products.
If an item is damaged during shipping, the complaint must be addressed to the carrier (PostNord or DSV (GLS)). Therefore, keep the packaging until the item has been inspected and the complaint approved.
Complaint items must be returned to ICG no later than 8 days after the complaint has been processed with ICG (see the section Return of Goods). A 1-year warranty is provided for appliances, etc.
If your order arrives damaged, please take photos and use [the complaint form] to submit your complaint.
All prices quoted are exclusive of VAT and delivery charges. If the goods are not paid for by credit card over the Internet or if no payment period has been agreed, the goods will be shipped cash on delivery plus freight and shipping charges.
If a payment term has been agreed, the goods will be invoiced as soon as the order is shipped and the payment term will be counted from the invoice date.
ICG retains title to delivered products until the purchase price is settled.
Any discounts are always granted in comparison with the generally applicable wholesale prices and cannot be combined, either among themselves or in conjunction with other offers, promotional prices or the like. Discounts, offers and promotional prices may be withdrawn by ICG at any time up to the delivery date without prior notice.
If the customer fails to meet a payment deadline, or if the credit limit has been exceeded, orders will subsequently be shipped only against prepayment.
If the reminder of missing deposits is necessary, a reminder fee of EUR 15,00,- per reminder will be attributed, as well as interest will also accrue, according to the provisions of the Danish Interest Act. If, after the second reminder, there is still an overdue balance and no installment payment has been agreed upon or is not fulfilled, the case will be reported to the RKI register (register for "bad payers") and handed over for collection.
Unless the return concerns a complaint/claim, goods are normally not accepted for return and may therefore only be returned by special agreement on a case-by-case basis. If such an agreement is made, the goods must be returned in saleable condition and in the original packaging.
All return goods must - regardless of the reason for return - be packed securely, and the packaging must clearly state a 6-digit return number issued by ICG in each individual case. Return goods must be received by ICG no later than 8 days after the return number has been issued, after which the return authorization will be cancelled.
If a shipment, due to circumstances on the customer’s side, cannot be delivered and is also not collected within any storage period, ICG may charge the customer for any costs related to return handling and/or reshipping.
A return handling fee of DKK 50 per package will be charged.

To the extent that ICG may be held liable to the customer under the Danish Product Liability Act, ICG's liability shall be limited to product liability and shall exclude any liability for loss of profit, transportation costs, operating losses, etc. ICG assumes no liability as a result of a customer's legal relations with third parties.
All course registrations are binding. Shortly after course registration, a confirmation of registration will be sent together with the invoice or deposit invoice. Payment must be made within the period indicated on the invoice, usually within 1 month before the start of the course. Lack of timely payment is not considered a cancellation.
In case of cancellation up to 21 days before the beginning of the course, 75% of the total course price will be credited. Cancellations between 8 and 20 days prior to the start of the course will be credited with 25% of the course price. No refunds will be given for late cancellations or no-shows. All cancellations must be made in writing to info@icgroup.dk. Rescheduling of courses may occur up to 30 days prior to the course date without a fee. Course rescheduling less than 30 days prior to the course start date will result in an administrative fee of 20% of the course price for re-booking.
If you are unable to attend the course start date due to acute illness, we will offer you a new course at 20% of the original course price paid. If you become ill after the beginning of a course, we will try to find a place in another course for you in relation to all the lost days.
The course place can be transferred to another person if the necessary course requirements are met. In that case, ICG must be informed no later than the day before the course starts.
We try as much as possible to carry out all scheduled courses. However, we reserve the right to cancel or postpone courses at short notice due to, for example, acute illness or lack of registrations. If this is the case, we will find a new course place for you as soon as possible, and if we are unable to do so, you may be refunded your payment for the cancelled course.
ICG reserves the right to cancel or reschedule courses due to unforeseen circumstances such as illness or lack of participants. If this is the case, the customer may request a full refund of the course fee.
If you participate in our courses or training evenings, we will reward you with up to 10% discount on the products you may order during the course or training evening. The discount applies only to products you purchase for your personal use, and the discount cannot be combined with any other discounts or discount promotions at ICG.
If you have booked a free training and cannot attend it, you are obliged to cancel via the booking portal or an email to info@insightcosmetics.de no later than the day before the event. In case of no-show without cancellation, we will charge a no-show fee of 49 EUR plus VAT.
From time to time Insight Cosmetics takes photos or videos from classes or events, where you as a participant and/or your work might be included. By participating in our classes or events, you grant Insight Cosmetics an irrevocable right and permission to use such photos and/or recordings for promotional purposes.
Images and texts on www.icgroup.dk and the associated pages are used with the consent and permission of the manufacturer. All rights therefore belong to ICG or our cooperation partners, including copyright and intellectual property rights.

Terms of sale and delivery, non-commercial
On www.insightcosmetics.de you can order products online. After entering your name, address, and contact information and approval of your order, you will receive an order confirmation by e-mail.
All RRP are in EUR including 19% VAT. The price at the time of order is valid, but data entry errors are reserved. Freight and shipping costs will be indicated before your purchase.
You can pay online by credit card and Visa card, or you can choose to ship the goods cash on delivery by paying a COD fee.
By paying by credit card you are always protected against abuse. Namely, you have the possibility to refuse the payment when you receive your payment summary. You have no excess in the event that your card is misused in an Internet store that uses SSL (Secure Socket Layer) in its payment system. The data you send when purchasing with a credit card is encrypted (SSL). Neither ICG nor anyone else can read the data. The amount of your purchases is debited only when the goods are shipped by ICG. It can never be debited a larger amount than you have authorized at the time of purchase.
Shipping your goods costs an amount. The freight depends on the weight and size of the shipment. ICG uses DPD or DHL as freight supplier and is not responsible for the delivery or delivery time if the shipping date was met. Delivery time is usually approximately 3-5 business days.
If ICG gets ordered goods returned due to incorrect, incomplete information about the delivery address, or because you are not at home to accept the shipment, you will bear the cost of redelivery with the supplier to the correct address. Therefore, please provide us with accurate information about the delivery address.
If the customer is a consumer in the sense of § 13 BGB, she/he/they has the following legal right of withdrawal:
You have a 14-day right of withdrawal on goods when you shop as a private person at ICG (this does not apply to courses). The right of withdrawal runs from the day you receive your item.
The right of withdrawal can only be exercised if the goods are returned in the same condition and quantity. The right of withdrawal therefore expires if you use the item in a way that clearly significantly reduces the item's sales value.
When the right of withdrawal is exercised, you must pay the postage yourself to send the item back. Before returning, you must contact ICG to obtain a return number, which must be written on the outside of your shipment near the address.

You can also cancel by refusing to receive the item at the post office, or by prior agreement hand it in personally at the above address. When you cancel your purchase, the purchase price will of course be refunded to you. This is done by a transfer to your bank account when we have received the item back and checked that it complies with the rules for cancellation. It is therefore important that we receive your registration number and account number.
It is not a requirement, but the expedition is facilitated if sufficient information accompanies the package - for example, a copy of the order confirmation, registration number and account number for the bank account to which reimbursement can be made, copy of any prior correspondence etc
Please note - we do not accept packages sent by cash on delivery.
It is always a good idea to save the original packaging until you have decided whether you want to keep the purchase or not. Lack of packaging can in some cases mean that the sale value of the goods deteriorates, and thus the right of withdrawal cannot be used.
If the customer wants to cancel the contract, he can fill out the following form and send it back to the provider. However, the form is not mandatory.

You can also cancel the purchase by refusing to accept the goods at the post office, or by returning goods in person to the above address against advance notice. If you cancel the purchase, the purchase price will of course be refunded to you. This will be done by a transfer to your bank account once we have received the goods back and verified that they meet the rules for withdrawal. It is therefore important that we receive your bank routing number and account number.
It is not a requirement, but it will aid processing if the package is followed by sufficient information - for example, a copy of the order confirmation, bank routing number and account number of the bank account to which the refund can be transferred, copies of any previous correspondence, etc.
Note: We do not accept cash on delivery shipments.
It is always a good idea to keep the original packaging until you figure out if you want to keep the item or not. Lack of packaging can in some cases mean that the retail value of the goods will deteriorate, and therefore the right of withdrawal cannot be claimed.
When you shop at ICG, you have the right to complain in accordance with the general rules of Danish law. This means that, depending on the specific situation, you can either have the goods repaired, exchanged or refunded, or get a price reduction. This is of course under the condition that the complaint is justified and that the defect has not been caused by incorrect use of the product or other damaging behavior.
The goods must be complained about within a reasonable period of time after the defect has been discovered. If the complaint is made within two months after discovery of the defect, the complaint is always in time.
We will refund reasonable freight charges that you should have in relation to the return of the goods if the complaint is justified.
If you want to complain about a product, it should be returned to us at our address. When you return the product, you should include a description of the defect. Note: We do not accept cash on delivery shipments.
Please always remember to return the product in proper packaging and get a receipt for shipping so we can refund your cost.
Cookies
A cookie is a term for the fact that the user's behavior on a network is registered with the user himself (on the user's hard disk). In this way, the server (e.g. a website) knows who the user is the next time the user visits.
No personal data is stored in cookies, but information about behavior on a website, e.g. a user name entered when logging into a special area on the website. Cookies are stored on the user's hard drive along with cache files. Thus, a cookie is a text file that is sent to your browser from a web server and stored on your computer's hard drive. You can set your browser to notify you when you receive a cookie, or you can choose to disable cookies altogether.
These cookies are used solely to recognize your PC.
Technically, cookies can be divided into two types. One type is called "session cookies." Session cookies are required to keep track of what you have added to your shopping cart as you continue to navigate the site. Session cookies are not stored on your PC, but disappear when you close your web browser.
There is another type of cookies called "persistent cookies" and they are stored as text files on your PC for about a month. Persistent cookies help our server recognize your computer the next time you log on to our website.
On www.insightcosmetics.de cookies are used to optimize the website and its functionality, thus making your visit as easy as possible for you.
You always have the option to delete cookies from your computer. For example, proceed as follows: In Internet Explorer 5.X, cookies can be deleted as follows: "Tools" -> "Internet Options" -> "Delete Cookies".
Log statistics
Log statistics are used on www.icgroup.dk. This means that a statistics system collects information that can give a statistical picture of how many visitors have been on the website, where they come from, from which part of the website they leave, and so on.
On www.icgroup.dk log statistics are used to optimize the website and its functionality.
Personal Information
To enter into a contract with us through the website, you must register with the following personal information: Name, address, telephone number, e-mail and your personally chosen password. We register your personal data with the purpose of being able to deliver the goods to you. Personal data is registered by ICG and stored for 5 years (5 years according to the Accounting Act), after which the data is deleted.
Your data is secured so that only dedicated administrative and accounting staff have access to your personal information. We store all your customer data in encrypted server and also send customer data encrypted.
Information provided to ICG is not shared or sold to third parties in any way, and we do not record sensitive personal information.
If you are registered with ICG, you always have the right to object to the registration. You also have the right to see what information is recorded about you. You have these rights under the Danish Data Protection Act, and requests in this regard can be directed to ICG by email:

Limitation of Liability
ICG cannot be held liable for indirect losses, including consequential losses, loss of business and revenue, loss of profit, loss of time, loss of use or other indirect losses, unless otherwise provided for under the general mandatory rules of Danish law.
Any disputes arising from the purchase and order of goods etc. from ICG shall be governed by Danish law.
